By accessing or using Brandyx Games (the "Service") at brandyx.page, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must stop using the Service.

Brandyx Games is a free, browser-based game aggregator. We curate, organize, and embed HTML5 games developed and hosted by independent third parties. We do not develop the games ourselves and we do not require an account to play.

We may add, remove, modify, or discontinue any game, feature, or section of the Service at any time, with or without notice.

You must be at least 13 years old (or older, where required by local law) to use Brandyx Games. By using the Service, you represent that you meet this requirement.

When using Brandyx Games, you agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Use bots, scrapers, or automated tools to access, copy, or interfere with the Service, except for legitimate search-engine indexing.
• Attempt to bypass, disable, or otherwise interfere with any security or access-control feature.
• Upload or transmit viruses, malware, or any malicious code through the Service.
• Harass, threaten, or impersonate Brandyx Games, its staff, or other users.
• Use the Service to advertise commercial products or services without our prior written consent.
• Reverse-engineer, decompile, or attempt to extract source code from any embedded game.

5.1 Our content

The Brandyx Games name, logo, design, editorial text, ratings, and original graphics are owned by Brandyx Games or our licensors and are protected by copyright and trademark law. You may not copy, reproduce, or redistribute them without our written permission.

5.2 Third-party games

All games, characters, artwork, music, and trademarks appearing on Brandyx Games are the property of their respective owners. We display and embed them under license or with the developer's consent. Use of any third-party game is governed by that developer's own terms and end-user license agreement (EULA), which may be presented to you inside the game itself.

Brandyx Games is a discovery and embedding layer only. We do not produce, control, or endorse the third-party games embedded on our platform.

Specifically:

• The content, legality, accuracy, and quality of each embedded game is the sole responsibility of its developer and host.
• Game availability may change without notice; we may delist titles at any time.
• In-game advertising, in-game purchases, leaderboards, and data-collection are controlled by the third-party host.
• External links from a third-party game or from our editorial content are provided for convenience. Brandyx Games does not endorse and is not responsible for the content, policies, or practices of any third-party site.

If you are a rights holder and believe content on Brandyx Games infringes your copyright or trademark, please send a written notice to [email protected] including:

• Identification of the copyrighted/trademarked work claimed.
• The URL on Brandyx Games where the allegedly infringing material appears.
• Your contact information (name, address, email, phone).
• A statement of good-faith belief that the use is not authorized.
• A statement, made under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the owner.

We will review and act on valid notices promptly, typically within 48 hours.

Brandyx Games may display advertising, including ads served by Google and other third-party ad networks. Some of these ads may be personalized based on information collected by the ad provider. See our Privacy Policy for details and for instructions on how to opt out of personalized advertising.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Brandyx Games DOES NOT WARRANT THE ACCURACY, RELIABILITY, OR QUALITY OF ANY THIRD-PARTY GAME OR CONTENT. GAME AVAILABILITY, PERFORMANCE, AND BEHAVIOR ARE CONTROLLED BY THEIR RESPECTIVE HOSTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL Brandyx Games, ITS OWNERS, OPERATORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF Brandyx Games HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You agree to indemnify and hold harmless Brandyx Games and its operators from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your use of the Service, or your violation of any law or third-party right.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties.

These Terms are governed by and construed in accordance with the laws applicable to the operator of Brandyx Games, without regard to conflict-of-law principles. Any dispute arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the competent courts of that jurisdiction, unless mandatory consumer-protection laws of your residence apply.

We may update these Terms from time to time. The "Last updated" date at the top will reflect any changes. Material changes will be highlighted on the homepage for at least 14 days. Your continued use of Brandyx Games after changes take effect constitutes acceptance of the updated Terms.

If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
